1. Scope and acceptance

The seller is EIXAM TECHNOLOGIES S.L. (EIXAM), with the details above. By pressing the order button with an obligation to pay you accept these terms.

The terms are offered in several languages for convenience. If they differ, the Spanish version prevails, without prejudice to the rights that the mandatory law of your country of residence gives you as a consumer.

2. Products and prices

The main characteristics of each product are on its page in the shop. The EIXAM tag is sold with its lanyard and its magnetic USB charging cable; it works with the SOS Eixam app.

Prices are in euros and include Spanish VAT. The total price, with shipping and the taxes for your delivery address, is shown before you pay. The price that applies is the one in force when you place the order.

For deliveries to other European Union countries, the VAT of the destination country applies (OSS scheme).

For deliveries to the Canary Islands, Ceuta and Melilla, prices carry no VAT and EIXAM pays the import taxes and formalities (delivered duty paid): nothing more to pay on delivery.

3. How the contract is made

Steps: you choose the products, give your details and address, review the summary with the total price and pay. Before paying you can correct any detail with “Edit details” or go back to the basket.

The contract is made when the payment is confirmed and we email you the order confirmation. We keep the order and you can look it up with the order number; the confirmation email and the invoice are your proof.

We may cancel an order, with a full refund, if there is an obvious pricing error, we are out of stock or we detect fraudulent use of the payment.

4. Payment

We accept card, Apple Pay, Google Pay and PayPal through Stripe, with strong authentication when your bank requires it. EIXAM never sees or stores your card details.

If the payment is not completed within 24 hours, the order is cancelled at no cost.

5. Invoices

We issue a simplified invoice unless you give a Spanish NIF, in which case we issue a full invoice. Above €3,000 the NIF is required.

Invoices are registered with the Spanish Tax Agency VERI*FACTU system and emailed to you.

6. Delivery and shipping

We ship to Spain (including the Canary Islands, Ceuta and Melilla) and to the European Union. Shipping costs are shown in the summary before you pay. We need your phone number so the courier can contact you.

We deliver the order within 30 calendar days of the contract at most, unless we tell you another date. If we do not, you can give us a suitable additional period and, if we still do not deliver, cancel the contract and get a refund of what you paid.

The risk of loss or damage passes to you when you receive the order. Check the parcel on receipt and, if it arrives damaged, write to us with photos of the packaging.

7. Right of withdrawal

As a consumer you have 14 calendar days to withdraw from the contract without giving any reason (articles 102 et seq. of Spanish Royal Legislative Decree 1/2007). The period starts on the day you receive the goods, or a third party you named, other than the carrier, receives them; if the order arrives in several deliveries, on the day of the last one.

To exercise it, use the “Withdraw from the contract here” button on the shop’s withdrawal page, or tell us clearly at hello@eixam.io with your order number; you can use the model form on that page. It is enough to send the notice before the period ends. We will email you an acknowledgement of receipt.

Send the product back, with its lanyard and cable and in good condition, without undue delay and within 14 days of telling us you withdraw. The direct cost of returning it is yours.

We will refund all payments received, including standard shipping, with the same payment method, within 14 days of you telling us you withdraw; we may withhold the refund until we receive the product or proof that you sent it back. If you chose a more expensive delivery than standard, we do not refund the difference. You are liable for any loss in value caused by handling beyond what is needed to check how it works.

EIXAM Care can be cancelled within the same 14-day period.

This right belongs to consumers; not to buyers acting for their trade or profession.

8. Legal guarantee and EIXAM Care

Products carry the three-year legal guarantee of conformity from delivery (articles 114 et seq. of Royal Legislative Decree 1/2007). If a product does not conform, you are entitled to have it repaired or replaced and, if that is impossible or we do not do it within a reasonable time, to a price reduction or to cancel the contract. To use it, write to us with your order number and serial number.

The guarantee includes the updates to the tag firmware and to the SOS Eixam app that are needed for the product to remain in conformity for the period the law sets.

EIXAM Care is an optional extended warranty and support service, tied to the serial number of each tag. It does not replace or limit the legal guarantee.

9. Using the product

The EIXAM tag helps send alerts without phone coverage, but its reach depends on the available LoRa network, the terrain and the battery. It does not replace emergency services (112) or proper planning and equipment.

10. Personal data and local storage

The controller is EIXAM TECHNOLOGIES S.L. (details above). We use your name, address, phone and email to manage the order, shipping and invoice (performance of the contract), to meet tax and commercial obligations and to prevent payment fraud (legitimate interest). Without that data we cannot process the order.

We share it with those involved in the purchase: Stripe (payment), the carrier (name, address, phone and email, to deliver the order), our hosting and invoicing providers inside the EU and public authorities where the law requires. Stripe may process data outside the European Economic Area with the appropriate legal safeguards.

We keep it while the relationship lasts and then for the applicable legal periods (tax and commercial).

You can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to hello@eixam.io. If you think we have not handled your data properly, you can complain to the Spanish Data Protection Agency (aepd.es). More in the eixam.io privacy policy.

The shop stores on your device only what it needs to work (basket, language, theme and recent orders) and Stripe uses technologies needed for payment security. We use no advertising or analytics cookies; we log technical errors to keep the shop running.

11. Complaints

For any complaint write to hello@eixam.io; we will answer as soon as possible. Complaint forms are available to consumers. You can also contact the consumer authorities of your region or country.

We have not signed up to any alternative dispute resolution body for consumer disputes; if that changes we will say so here.

12. Governing law and jurisdiction

These terms are governed by Spanish law. If you are a consumer, you keep the mandatory protections of your country of residence and may bring proceedings in the courts where you live.

The terms that apply to each order are those in force when you place it.
